They are now in the hands of the New Mexico Children, Youth and Families Department.
Jany Leveille, Hujrah Wahhaj and Subhannah Wahha are believed to be the mothers of the children.
"We did an extensive search for the missing child, our primary target", he said.
The search for the young child began back in January, when Wahhaj's estranged wife, Hakima Ramzi, reportedly recorded a video on Facebook begging for help in finding her son.
The last reports of the father and son being seen in public together came on December 13, when they were involved in a single-vehicle accident on I-65 in Chilton County, Ala.
The boy's mother told police he left with his father, Siraj Ibn Wahhaj, for a trip to a park and never returned.

He was granted an appeal after a court found he was misinformed about when he would be eligible for release. According to the Daily Mail , Williams spoke over the judge and ignored multiple warnings to remain quiet.
Wahhaj and his son were last seen together December 13 after the vehicle they were in was involved in an accident in Alabama, CNN affiliate WGCL-TV reported.
Five adults were found at the scene, including two heavily armed men.
Wahhaj was the focus of the Georgia investigation, having been accused of abducting his son, while the sheriff's office believes the property was Morten's.
But at the time, Alabama police didn't hold the group after the traffic accident.

The sheriff's office said none of the adults, including the three women, gave a statement regarding the missing boy's current whereabouts.
